In reality, let us say what it really means.............opportunity ($$$$) is knocking from "collateral" issues; a key marketing method is to use cross marketing, emotion, and slick eye candy photos liberally. $$$$$  $$$$$  (vivid color photo,naked girls,cute puppy, sick puppy, sad music, whatever--Peta does it daily and huff post ain't far behind and neither is Yahoo news--probably the National Enquirer of the Internet, close to the English "news" online with rubbish, garbage, and sensationalism galore)

.......  the fact is HSUS could care less about the poor, ghettos or welfare families-- you don't see HSUS going to Los Angeles barrios to help stop the killing of animals that regularly flow from same area, and that makes up 50% of the intake AND 50% of the killing of shelter dogs? 
Nope, you will NEVER see HSUS even try to do it. Instead they go to Louisiana and fleece public of $34,000,000 [many of whom are black] -- then can only show evidence for $7m (as to how they spent it).......  Does anyone "NOT" understand what is going on???  Also, pitbulls if confiscated as alleged used for dog fighting-- become contraband under Louisiana law (because HSUS wrote it) so guess what? Contraband means seizure and kill instantly. HSUS already did this with Floyd Boudreaux's dogs. ALL of them were killed in 24hr. HSUS set up the spca people there so it could be done.
HSUS wanted ALL of Vick's dogs killed. But although rehabilitation is expensive (Best Friends charged $2,000,000) most of them were helped. BTW B Friends is a hoarding sanctuary. They keep 1,600 dogs there. Why?  Insane. 
2. Cockfighting and dogfighting are linked to gambling. Therefore money is changing hands and animals are involved. The only $$ that HSUS wants to change hands, is if IT GOES TO HSUS. For example, HSUS will visit the shelter, charge probably $95k to $150k, and tell them how they can kill animals faster. Example-- HSUS told the Lied shelter in NV, that because they had pathogen spreading in shelter (with 1,000 animals in there) that they should just kill ALL the animals and start over?!?  and they did.
 In fact, HSUS is often about killing animals; this is not obvious to most people. HSUS published a book for the sole purpose of knowing how to kill nearly every species alive. and Peta simply steals people's animals and kills them. Why else would the Peta freezer cost $9,000? [shown on their tax return]  HSUS' agenda is same as Peta's.... better dead than fed.
3.  If no one else will tell you, then you be the change and tell all of your Friends NOT to donate to HSUS, ASPCA or PETA, 3 of the biggest shams in the "welfare" of animals--they really want it to be "better dead than fed" and that's no joke. and tell your parents/grandparents/cousins and people you meet. You will find that most people have NO idea of this.  In fact Ingrid Newkirk (in charge of PETA) killed thousands of dogs in Washington DC shelter.....she worked overtime to kill more because she wanted to end their claimed "misery."
Misery means being alive, apparently,  because Peta kills tons of animals gleefully. To spare them from humans. PETA kills about 85-95% of ALL animals they take in or steal. It is stated on their yearly returns to the government.  We think Ingrid got PTSD like they do in wars. Killing too much of anything causes PTSD. That is no secret.
AND if you are going to BE a paralegal by chance, or involved with LAW, you CERTAINLY don't want to misunderstand what the hell is going on legally!!  We have found that JUDGES are very un-informed re animal rights.  Despite the Federal AETA (Animal Enterprise Terrorism Act) Pub.L. 109–374; 18 U.S.C. § 43.....which is seldom used, and mainly set up to thwart groups like the SHAC7, who got a combined total of 24yr jail time.

If you start now with your friends, they will later ask YOU questions because you know more than they do. ALWAYS research your sources for accuracy and do not ever believe what the  Big 3 groups say.....if they had it their way, they would probably kill all the people first and then sort out what's left. It would be like that boy and dog movie, the choice was he had to kill either the dog or the girlfriend. He didn't kill the dog. He ate the girlfriend. For food.
Any information out of England is animal rights. Sites clamoring for donations is usually animal rights (AR for short..) Groups using pictures of abused animals is AR. Rescues using same is definitely AR because it's very expensive to rescue animals.Using emotion gets them more $$$$.
An example of this is The Grace Foundation of Northern California, definitely AR, which used both video and far more in an attempt to claim that a horse owner was abusing his horses, when in fact, he actually did take in some rescued horses which would never have great health, but the main fact was that a horse ranch for over 100 years may easily contain skeletal remains which were certainly not traceable to horses owned by the accused plus, he was not accused of having killed anything related to any skeletal remains....the Grace group's non profit license was revoked by the AG Charitable Trust recently, and they lost the El Dorado ranch they had use of, by eviction. A post seizure hearing was conducted but owner did not attend since the storage fees were outrageous due to time lapse, and many of the horses were either missing, or had been sold off, or were previously switched by someone. 
Do you want to know how to tell if something is AR or which group is AR?
We don't necessarily believe what we read, we investigate. It takes time to learn how to tell if what you see is true. In most cases much of what you see (facebook,etc) is not true and not verified. The internet is tricky since anyone can post anything but it does not make it true. ARs are well known for widely using subterfuge and misrepresentation.
If it has the word "animal society" "humane society" be very very cautious-- if they spend $3,000 or $5,000 on one cat, it's definitely AR. (the cat is simply a marketing tool for them) If they go to FOREIGN countries to bring back STRAY ANIMALS---like best friends (utah) does-- run away immediately, do not give them a dime. It's not like they couldn't get strays in the USA--no, they just HAD to spend $140,000 and go overseas. Best friends was started as a cult by michael mountain and friends. Verified. How else do you think we even know?
 If they bring animals from Puerto Rico, Mexico, Japan, anywhere outside of the USA-- run, run away. Money mongering. This has brought rabies and an unknown new form of dog flu to the USA which has killed dogs. Recently.

Why You Should Avoid Giving Money to AR Money Mongers Like HSUS or ASPCA

One doesn't have to believe what is on here, BUT consider that BOTH HSUS and ASPCA--who claim they just want to "save" animals, but don't mind them being killed quickly-- consider that BOTH major groups, plus many other smaller AR groups--were accused of RICO (Racketeering charges) in their long Federal case over 14 years time--in which the involved AR groups--paid some guy to pretend he had some emotional "bond" with his animals the elephants, and so he was thus entitled to be the PLAINTIFF in the lawsuit against the circus.

BUT since it was PROVEN that this guy had no credibility, had no bond with the animals, and was being PAID to testify, that apparently equals RACKETEERING..........why???

HSUS/ASPCA and the others did NOT have to pay out millions but could have gone to trial on the racketeering charges.  Of course, they did not, because we all know they paid the guy to pretend and then testify for them.  Since he did a piss poor job of testifying and was found completely not credible, how in the world could the AR groups--who had PAID him to testify-- absolve themselves against RICO charges???  They could not, did not, and the AR groups paid, paid paid to get out of the case.  Amazingly, no one was arrested.  The circus, after wasting 14+ years on this crap, decided to phase out the elephants acts in the circus rather than to find themselves in yet another 14 year long case because we all know, AR activists never, never, never stop.  JIHADIST is how they are.

Would you take a parent who abused kids repeatedly, went to PRISON and then USE that person to teach kids not to abuse other kids???   OR-----even worse---- is it OK to do it because you are only bringing Vick to the black neighborhoods??????  Get the Drift???

Pacelle_DogOne of the problems with animal welfare policy—and public policy in general—is that demagogues on one side or another of a political issue make sleazy and unsupported attacks on the other. One of the scummier instances of this we’ve seen was during the 2012 election, when the lobbying arm of the misnamed Humane Society of the United States (HSUS) ran ads implying that Congressman Steve King of Iowa supported dogfighting.

A number of TV stations refused to run the ads, recognizing this HSUS bile for what it was. Essentially, King had wondered about whether it was worth passing a federal anti-dogfighting law when dogfighting is already illegal in all 50 states. But a question about state-vs.-federal resources gave HSUS the opportunity it needed to nip at his heels, even though King publicly clarified that yes, he is against dogfighting like every other sane person.

Unfortunately lies and rumors don’t die easily on the Internet, and last week a petition popped up slamming King for this (years-old) episode and closely tracking HSUS’s rhetoric. So far it has nearly 30,000 signatures.
It’s a good opportunity, then, to remind the public that HSUS CEO Wayne Pacelle has helped more dogfighters than Congressman Steve King (who, like most people, has helped zero).
Pacelle developed a bro-mance with convicted dogfighting kingpin Michael Vick following Vick’s release from prison. After Vick got out of the slammer, Pacelle and HSUS rehabilitated Vick’s public image. Vick controversially signed with the Philadelphia Eagles to resume his NFL career, and—coincidentally, perhaps—the Eagles gave a $50,000 grant to HSUS.
If that’s not nauseating enough, Pacelle later told the media that Vick “would do a good job as a pet owner.” Vick has since gotten a dog.
Disturbingly, there was also a significant increase in dogfighting in Pennsylvania following Vick’s hookup with Pacelle and HSUS. According to the Pennsylvania SPCA, in 2008, while Vick was still in prison, there were 237 investigations of animal fighting in the state. In 2010, there were 1,177—an increase of 400 percent. According to the Pennsylvania SPCA, this uptick in investigations included “an increase in actual dogfighting.”
Pacelle’s alliance with a convicted dogfighter sure seems to have produced a lot of other Vick-tims. And as for the dogs Vick helped abuse? Pacelle recommended back in 2007, when Vick was indicted, that they be killed. Many or most are now rehabilitated and in caring homes.
Wayne Pacelle likes to claim he speaks on behalf of animals. If the dogs could talk, they might tell Pacelle they don’t want him. It could be deadly.

7 Things You Didn’t Know About HSUS

1) The Humane Society of the United States (HSUS) is a “humane society” in name only. It isn’t affiliated with any hands-on “humane society” organizations, and it doesn’t operate a single pet shelter or pet adoption facility anywhere. During 2008, HSUS contributed barely $450,000— less than one-half of one percent of its budget—in grants to dog and cat shelters.
 By comparison, that same year it gave $2.25 million to a political campaign committee behind an anti-meat ballot initiative in California, and put $2.5 million into HSUS’s executive pension plan. HSUS is the wealthiest animal-rights lobbying organization on earth. It agitates for the same goals as PETA and other radical groups, but uses fewer naked interns.
2) Beginning on the day of NFL quarterback Michael Vick’s 2007 dogfighting indictment, HSUS raised money online with the false promise that it would “care for the dogs seized in the Michael Vick case.” 
The New York Times later reported that HSUS wasn’t caring for Vick’s dogs at all. And HSUS President Wayne Pacelle told the Times that his group urged government officials to “put down” (that is, kill) the dogs rather than adopt them out to suitable homes. HSUS later quietly altered its Internet fundraising pitch. Vick now gives HSUS “sponsored” speeches. And most of his dogs have been rehabilitated—without any help from HSUS.

3) HSUS’s senior management includes a former spokesman for the Animal Liberation Front (ALF), a criminal group designated as “terrorists” by the FBI. HSUS president Wayne Pacelle hired John “J.P.” Goodwin in 1997, the same year Goodwin described himself as “spokesperson for the ALF” while he fielded media calls in the wake of an ALF arson attack at a California veal processing plant. 
In 1997, when asked by reporters for a reaction to an ALF arson fire at a farmer’s feed co-op in Utah (which nearly killed a family sleeping on the premises), Goodwin replied, “We’re ecstatic.” That same year, Goodwin was arrested at a UC Davis protest celebrating the 10-year anniversary of an ALF arson at the university that caused $5 million in damage.

4) A 2008 Los Angeles Times investigation found that HSUS receives less than 12 percent of the money raised on its behalf by California telemarketers. Professional fundraisers keep the rest. If you exclude two campaigns run for HSUS by the “Builda-Bear Workshop” retail chain—which consisted of the sale of surplus stuffed animals (not really “fundraising”)—HSUS’s yield shrinks to just three percent. This is typical. In 2004, HSUS ran a telemarketing campaign in Connecticut with fundraisers who promised a return of “zero percent” of the proceeds. The campaign raised over $1.4 million. Not only did none of that money go to HSUS, but the group paid $175,000 for the telemarketing work. Similar filings exist in Massachusetts, New York, and other states. In 2008 HSUS collected more than $86 million in contributions, but spent more than $24 million on fundraising.


5) HSUS’s heavily promoted U.S. “boycott” of Canadian seafood—announced in 2005 as a protest against Canada’s annual seal hunt—is a phony exercise in media manipulation. A 2006 investigation found that 78 percent of the restaurants and seafood distributors described by HSUS as “boycotters” weren’t participating at all. 
Nearly two-thirds of them told surveyors they were completely unaware HSUS was using their names in connection with an international boycott campaign. 
Canada’s federal government is on record about this deception, saying: “Some animal rights groups have been misleading the public for years … it’s no surprise at all that the richest of them would mislead the public with a phony seafood boycott.” A documentary director also caught an HSUS film crew abusing a dying seal while they shot a 2007 fundraising video on the ice floes of Atlantic Canada.


6) HSUS raised $34 million in the wake of Hurricane Katrina, supposedly to help reunite lost pets with their owners. But comparatively little of that money was spent for its intended purpose
Louisiana’s Attorney General shuttered his 18-month-long investigation into where most of these millions went, shortly after HSUS announced its plan to contribute $600,000 toward the construction of an animal shelter on the grounds of a state prison.  In 2009, Atlanta ABC affiliate WSB-TV reported that public disclosures of the disposition of the $34 million in Katrina-related donations added up to less than $7 million.


7) After gathering undercover video footage of improper animal handling at a Chino, CA slaughterhouse during November of 2007, HSUS sat on its video evidence for three months, even refusing to share it with the U.S. Department of Agriculture. 
HSUS’s Dr. Michael Greger may have perjured himself before Congress, testifying that the San Bernardino County (CA) District Attorney’s office asked the group “to hold on to the information while they completed their investigation.” The District Attorney’s office quickly denied that account, declaring that HSUS refused to make its undercover spy available to investigators if the USDA were present. 
Ultimately, HSUS chose to release its video footage at a politically opportune time, as it prepared to launch a livestock-related ballot campaign in California. Meanwhile, meat from the slaughterhouse continued to flow into the U.S. food supply for months.

"The manure scraper had low levels of Campylobacter spp. recovery in all systems, but AV drag swabs and EC scratch pad swabs had high levels of Campylobacter spp. recovery

AV floor shells had the greatest levels of total aerobes and coliforms. Aerobic organisms were also elevated on AV nest box and system shells. Previous studies indicate total aerobe levels are greater on eggs produced in high dust environments. 

Eggs laid on litter (in AV only) have greater shell microbial levels than eggs laid on system wires or in nest boxes. 
Coliforms are indicators of fecal contamination which is linked to many human pathogens.

In the EC system wire egg shell coliform levels were detected at levels similar to CC. The coliform level in AV nest box egg shells was similar to the EC. The coliform levels were low for all shell samples, excluding the AV (cageless) floor shells, which had the highest levels of total coliforms.

In other words, the AV (cage free) eggs had the highest level of pathogens overall.
And this is what HSUS wants people to have, so they can be more likely to get sick and then stop eating the eggs.  Are you beginning to catch on to what is really going on?  In other words, the animals are way more important than the people who raise the hens or the consumers.

HSUS, PETA and the rest, exist simply to stop people from eating any food from animals, using any animal products at all, watching animals perform in training and movies, the military, the police, service dogs, guard dogs, whatever;  to stop the sales/ownership or trading of animals, even livestock.  Because in the AR mindset, ANIMALS are actually far better or superior to people, so people really do not count.

If you had not noticed by now, the entire California Penal Code on "animal abuse" is basically patterned after the Welfare and Institutions code.  So in other words, groups like HSUS and various AR attorneys simply want animals to be treated as if they were children, with all of the laws that apply to kids, but to apply them to animals. Words such as guardianship, losing custody of animal, obtaining a restraining order with no contact of animal, obtaining a "pet trust" or appointing an "executor" for a pet;  appointing a "guardian" for an animal to act as its attorney, attempting to claim that the US Constitution applies to Orca whales (the Constitution only applies to humans) --and Peta actually filed the Federal case in san Diego, taking 2 years of prep time to get it ready!!! Of course it was shut down by the Court. 

One of the reasons why many paralegals would not be good for an animal attorney that represent an owner, seller, buyer or other animal related issue,  is because they are brainwashed into believing everything HSUS says?  We have very few law students or paralegals that really understand the TRUTH.  

They are so propagandized by media, huff post, examiner. com and countless AR influenced sites, that they simply do not understand the truth by any stretch.  Most law students tend to be AR leaning because they have been brought up to think that animals are always abused.  The truth is that animal abuse is not near as rampant as ARs would have one think, which is why many attorneys have no clue about the penal code and animal "abuse."  Negligence, however, is whatever the Animal control SAYS it is, because you can take something legal, and by claiming subjectively something else, it becomes "abuse."

For example, there is no LAW that says a child or a senior adult must live in a residence, or that such residence even have an air conditioner?  Many houses don't have air conditioners.
Yet the HSUS, when they write up specifications for any type of kennel formation, they always want the ambient air to be temperature X to Y and not higher than 80 degrees for example.

Then, in the book (manual) on how to KILL almost any type of animal, HSUS says that music and a cheerful room will help people kill the animals more easily without becoming depressed?  And that killing is a team effort.  Oh sure they don't call it "killing" but the entire book is on how to kill any type of animal. The way that HSUS thinks it should be done. Why is HSUS an authority on killing animals? Truthfully, they are not experts.  They like to say they hire them, but not every expert has the same opinion.  HSUS is a money making enterprise, doesn't matter that it is a non profit.  ACORN was a non profit.  Any group that markets, takes donations, but then does not tell the truth and misrepresents things, is not a group that should make laws for other people in our opinion.  Whether related to animals or not.
 


By doing some research, one will find that AR groups only push things they can profit from.  For example, an AR group wants to take advantage of a seizure of animals for (1) free publicity   (2)  free air time and print, and time to pitch the emotional drivel  (3) free interviews  (4) many minutes to make the pitch for $$$$$ donate, donate, donate  (5)  opportunities to then brainwash the children of the people that respond as well  (6)  obtaining your personal email   (7) using new members to gain incentives from credit card companies  (8)  Testing out new advertising on younger and younger kids  (9) Trying to convince young people that the "exceptions" in life are in fact the norm, when they are not  (10)  Using hypocrisy and misrepresentation galore, such as hiring a convicted dog fighter, dog torturer Michael Vick-- and then pimping him off on poor kids in poor neighborhoods to make themselves (HSUS) look good-- but we saw through that in 1 second, whereas many people thought it was "great?"  

Remember that via propaganda, Hitler was able to convince enough people that killing all of the Jews was a necessity.  Now if HSUS told you that all animals should be killed rather than let people buy them, would you fall for it?  You just might if you didn't actually understand the law they wrote.  When a law is written on purpose, and no one tries to stop it, it can be illegal as hell, as long as they pass it. If no one votes it down, if the legislature passes it, it is the LAW.

 HSUS badly written laws out of California have been struck down by courts. But they (HSUS) won't tell you that. Instead they will word an article such that you won't even realize their law was struck down.  Trust us, we have seen it plenty of times. 

For example, U.S. v Stevens, a first amendment case where HSUS law was not only used inappropriately, it was completely unconstitutional as written and as applied.  Yet to read HSUS' version, they never admit it was unconstitutional and instead bragged that the new version was easily passed. YEAH-- after being struck down like 10million pounds by the United States Supreme Court.  We don't believe that the SCOTUS even likes HSUS.  After all, they hire former PETA, ALF or ELF or whatever criminals they can get.

But the science around the health of cage-free birds is less clear.Janice Swanson, an animal scientist at Michigan State University, has been leading a three-year study of egg production techniques.
She says cage-free birds have more feathers and stronger bones and exhibit more natural behaviors. But crowded aviaries also come with risks: reduced air quality, and twice the likelihood of dying. Over the course of their three-year study, less than 5 percent of birds in cages died, compared with more than 11 percent of cage-free birds. One of the most common causes of death was pecking by other chickens.
No Hormones
What You Might Think It Means: These birds were spared injections of nasty hormones that might cause them to sprout hair in unusual places and render them unhealthful for us to eat.
What It Actually Means: This term is rather misleading, because it's illegal to give hormones to poultry, and no large-scale farms in the U.S. do so. It's like putting a label on a cereal box that says, "No toxic waste."

The bottom line is that if every single egg was from chickens that just ran around outside and ate bugs, the birds would not probably get complete nutrients, the eggs could be laid anywhere (unless they were trained to lay in nest inside) and cleaning eggs which are not done in a production method is more difficult as they would be hand gathered, taking a huge amount of employee time. And if you have looked at most eggs labeled from free range, they can show blemishes on the outside and not all consumers like to buy eggs that have any kind of marks on the shells.  For that matter, most people just buy eggs from the store and don't think about whether it's pathogen free.  Having raised chickens, one cannot tell just by looking at an egg as to whether or not it may have a very small break in the shell.   A chicken that is free range outside can encounter numerous rodent droppings, or many types of dangerous pathogens that can lead to the chicken becoming ill.
Chicken illness for caged chickens is more easily handled because there is more control over the environment.  Actual free range (let's pretend 3 acres, no aviary netting) with some grass, weeds and whatever is in the ground before the grass got there.  Wild ducks it is believed, have flown over areas which then resulted in avian pathogens which have killed millions of birds; once a flock is infected, usually the entire group has to be killed.  Example:
A wild duck in Butte County in northern California has tested positive for highly pathogenic avian influenza, adding to a string of unprecedented West Coast bird flu cases. The U.S. Department of Agriculture on Wednesday confirmed that a hunter-shot duck in Butte County was infected with highly pathogenic H5N8. The USDA detected the virus Dec. 31, but didn’t make an announcement until Wednesday. 
The wild duck was found as part of the USDA’s increased surveillance on the West Coast and increased outreach to backyard poultry enthusiasts, according to the USDA. Highly pathogenic bird flu had never been detected in California, Oregon and Washington until the past month. Low pathogenic bird flu was found last spring on a quail farm in Stanislaus County in central California. 
China still restricts all poultry and poultry products from birds slaughtered, processed and shipped from California. Unlike British Columbia, Canada, where some 245,600 birds were culled at 11 poultry farms between Dec. 1-17, highly pathogenic bird flu has not been found in U.S. commercial poultry. The virus in wild birds and backyard flocks in Washington and Oregon has still meant export restrictions for the U.S. poultry industry. “It’s possible every additional finding prolongs the situation,” USA Poultry and Egg Export Council President Jim Sumner said Wednesday. Some countries, such as South Korea and South Africa, have imposed bans on all U.S. poultry. The USDA says those bans are unwarranted. 
Many countries have limited their bans to poultry and poultry products from Washington and Oregon. Federal and state officials Tuesday euthanized approximately 500 birds in a backyard flock in Benton County in south-central Washington. The flock had been exposed to highly pathogenic H5N2 bird flu by domestic ducks moved from another flock 9 miles away. The 140 ducks, chickens and turkeys in that flock were euthanized Monday, according to the Washington Department of Agriculture. Also in Whatcom County, Wash., a wild duck and a captive gyrfalcon fed wild duck were infected with highly pathogenic bird flu in December. Also that month, highly pathogenic bird flu broke out among a 100-bird flock of guinea fowl and chickens in Douglas County, Ore. Officials suspect migratory waterfowl along the Pacific Flyway are carrying the disease. Highly pathogenic bird flu cases also have been reported in Asia and Europe within the past two months. No human cases of the viruses have been reported, according to the USDA.

The United States Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS) has confirmed the presence of highly pathogenic (HPAI) H5N8 avian influenza in a commercial turkey flock in Stanislaus County, California. This is the first finding of HPAI in commercial poultry during the ongoing disease incident in the Pacific Flyway. 
No human cases of these avian influenza viruses have been detected in the United States, Canada, or internationally, and there continues to be no public health concern. Samples from the flock, which experienced increased mortality, were tested at the California Animal Health and Food Safety Laboratory System (CAHFS) and the APHIS National Veterinary Services Laboratories in Ames, Iowa confirmed the finding. APHIS is partnering closely with the California Department of Food and Agriculture (CDFA), which has quarantined the facility. 
APHIS and CDFA have initiated an incident command response, and APHIS will assist CDFA in depopulating the remaining birds on the property to prevent the spread of the disease.* Birds from the involved flock will not enter the food system. H5N8 has not been shown to present a health risk to the public. As a reminder, the proper handling and cooking of poultry and eggs to an internal temperature of 165 °F kills bacteria and viruses.

Animal Law Issues + Paralegals--Here is a Prime Example

Easy, fast way to learn why Animal Lovers Get Fleeced by groups like HSUS and ASPCA (click link)  and remember, BOTH of these groups paid out MILLIONS on civil RICO charges (racketeering) when sued by the circus (Feld Entertainment) after a 14year lawsuit in Federal Court finally ended, with the animal activists LOSING their case. Attorney fees were undoubtedly awarded against HSUS, ASPCA and other groups.  Rather than taking 14 years of Federal Court time, imagine if they had instead, worked to get animals new homes and done something productive?

UPDATE, RE SUSANVILLE HORSE CASE: Originally published 2011-2013, now its 2015...

The seizure of the animals was done by the bank "Receiver" on paper, but in reality, the bank attorney controlled the Receiver AND executed a written indemnification which is really not appropriate, since Receivers are supposed to be neutral parties, not working for ONE party.
Further, upon the seizure of the animals, there was no warrant and there was no exigency but bank attorney said it was a medical exigency when it was not.

There was no opposition allowed for owner to contest the taking which is also improper.  Currently, 3 years later, the Superior Court ruled that the Receiver was wrongfully appointed. The banks are attempting to allegedly "clarify" this but the wrongful nature of the entire proceeding was wrong from the start, however the Court then changed its mind and found that the appointment of the Receiver was correct. As for the method or actual actions by the Receiver, the Court did not claim it was errant or not errant (which the banks wanted...)

     Unfortunately, Lassen County is corrupt and even though there are really no expert witnesses, Lassen will claim to use an outside expert and no first hand experts. The vet that initially purported to state that the horses were either "abused" or "neglected" has stated he will not testify and they would have to basically handcuff him and force him to testify. So using an alleged drug charge, Lassen claims they will either convict horse owner on drugs or on animal charges. He is definitely not guilty of any animal abuse and from what we hear the drug charges are simply coercion by police.

The rescuer who formerly had the vet do the alleged inspections has seen her "non profit" have its license revoked for failure to produce income tax returns, not coincidentally, at just the same year that the animals were seized and forward-- therefore, no one will know how much The Grace Foundation made off of using the Lassen horses predicament.

The banks then worked a deal with one of the raw land owners (former girlfriend)  and allegedly sold out her "share" for $200k, meaning the former horse-land owner's raw land, is owned in part by "the banks?" How awful. Nothing has been done about the Receiver (who was really the bank attorney Ryan) or the failure to allow the debtor to exempt his personal property.  Grace former CEO DeCaprio may have reported to the California State Bar on the bank attorney but as far was we can see, nothing has been done to him at all.  

Although we are not surprised at this, because Grace CEO should have never worked with the bank attorneys, both the Grace CEO conducted the non profit improperly, and the bank attorney conducted the receivership improperly. A receiver should be a neutral party but instead was completely controlled by bank attorney for most part. We do not forsee that this case will end very well, mostly because too much time has gone by and the evidence does not necessarily get better with time. Although there is good evidence against the bank (at least one of them) if no one can find an attorney to bring the case forward by now, it's unlikely to have a huge success in the future, especially if the witnesses are either paid, or other subterfuge is used, which we are sure will happen.

HSUS,ASPCA+Others Pay MILLIONS to Settle RICO Claims Against Them


A decade-long legal battle is finally coming to a close after the American Society for the Prevention of Cruelty to Animals (ASPCA) agreed to pay the owners of the Ringling Brothers and Barnum & Bailey Circus $9.3 million for alleging the circus abused their elephants.

The lucrative settlement was announced on Friday, according to papers to filed in federal court in Washington, D.C., Courthouse News reports.
“Animal activists have been attacking our family, our company, and our employees for decades because they oppose animals in circuses,” Kenneth Feld, chairman and chief executive officer of Feld Entertainment, said in a statement obtained by Bloomberg. “This settlement is a vindication not just for the company but also for the dedicated men and women who spend their lives working and caring for all the animals with Ringling Bros.”
The original allegation of mistreatment against the show's trained Asian elephants was filed in July of 2000, but was sullied by revelations that the key witness for the animal rights group was paid to testify, NBC News reports.
Former Ringling Bros. employee Tom Rider was responsible for caring for the elephants between 1997 and 1999. The circus won at trial in December 2009 when a judge ruled Rider's testimony was suspect, according to Bloomberg.
"The court finds that Mr. Rider is essentially a paid plaintiff and fact witness who is not credible, and therefore affords no weight to his testimony regarding the matters discussed herein, i.e., the allegations related to his standing to sue," U.S. District Judge Emmett G. Sullivan wrote in his 2009 opinion, according to CNN.
